COMPLIANCE AGREEMENT, LIABILITY WAIVER, RELEASE OF CLAIMS, AND TERMS AND CONDITIONS

As a participant, volunteer, or attendee in the Event held or sponsored by Aspen Gay Ski Week and AspenOUT (AGSW-AO), its contractors and affiliates, you agree to comply with all applicable state laws, the rules set forth by the sponsor, contractor or their affiliates and the specific venue’s policies and procedures. If a violation of these laws, rules, policies or procedures is discovered, AGSW-AO, its contractors and affiliates and/or the venue (“Event Parties”) may take any action deemed appropriate, including expulsion from the event without refund and/or disqualification from attending future events. If you do not agree to abide by the Terms and Conditions stated here, you shall not attend the Event in any capacity.

Event Cancellation Delays Acknowledgement. AGSW-AO reserves the right to modify, reschedule, or cancel any Event, at any time and shall use good faith efforts to notify participants. AGSW-AO shall not be responsible for any such delays, changes, or cancellations.

No Warranties Acknowledgement. AGSW-AO MAKE NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. EVENT ATTENDANCE IS AT YOUR OWN RISK.

Limitation of Liability & Release Acknowledgement. As a participant, volunteer or attendee in the Event held or sponsored by AGSW-AO, you agree to all terms and conditions contained herein. In consideration of your access to and participation in the Event, you agree, that in no event will AGSW-AO or any of the Event Parties be liable under any theory for any lost profits, lost data, lost opportunities, costs of cover, exemplary, punitive, personal injury/wrongful death, contraction of illness or disease, special, incidental, indirect or other consequential damages, and you release AGSW-AO and Event Parties from all such claims. Further, to the fullest extent permitted by law, in no event will AGSW-AO or Event Parties be liable for damages resulting from your access to or participation in the Event.

Acknowledgment & Assumption of Risk., Release, And Waiver of All Claims. As a participant, volunteer or attendee at the Event held or sponsored by AGSW-AO, you acknowledge that you derive personal satisfaction and benefit by virtue of your participation and/or voluntarism with AGSW-AO, and you are willingly engaging in AGSW-AO events and/or other fundraising activities. As a participant, volunteer or attendee in the Event held or sponsored by AGSW-AO you acknowledge that AGSW-AO events can include physical and social activities including, but not limited to skiing, snowboarding, elevated terrain, crowded venues, alcohol, and other risks. These risks include, but are not limited to, risks associated with weather, equipment malfunctions, fire hazards, exposure to infectious diseases, food safety, security issues, over consumption of intoxicants, medical emergencies, venue safety concerns, falls, collisions, and terrain hazards. As a condition of your registering for and attending the Event, you hereby forever release and discharge AGSW-AO, together with its affiliated directors, board members, insurers, sponsors, volunteers, event producers, and assigns from any and all liabilities, causes of action, damages, indemnities, obligations, debts, claims and demands of every kind and nature, both in law and in equity, known or unknown, fixed or contingent, based upon or in any way related to risks of participation whether inherent, foreseen, or unforeseen.

Indemnification Acknowledgement. I agree to indemnify, defend, and hold harmless AGSW-AO, together with its affiliated directors, board members, insurers, sponsors, volunteers, event producers, assigns, Event Parties and their respective employees, contractors, and distribution partners from and against any and all claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to (i) your access to, attendance at, or participation in the Event, (ii) any breach by you of any of these Terms and Conditions, (iii) your violation of applicable law.

Media Authorization. I authorize and grant AGSW-AO, sponsors, and its designees the irrevocable right to photograph or record me at events I attend. I grant AGSW-AO, sponsors, and its designees the right to use photos and videos taken of me in print, or in digital formats. I grant AGSW-AO, sponsors, and its designees the right to use the photos or videos on their social media platforms including but not limited to Facebook, Twitter, Instagram, and other social media platforms. I grant AGSW-AO, sponsors, and its designees the right to edit, alter, copy, or distribute photos and videos taken of me for media advertising and marketing. I agree that the photos and video footage taken will belong to AGSW-AO, sponsors, and its designees. I understand that I will not receive any monetary compensation for any footage taken of me.

Representation for Others and Ticket Transferability. If I am signing on behalf of others whose tickets or passes I am picking up or purchasing, I confirm that I have the legal authority to bind those individuals to this Agreement, Liability Waiver, and Release of Claims. I further affirm that they have been informed of and agree to the terms outlined in this waiver. I accept responsibility for ensuring their understanding and compliance with all conditions herein. Additionally, if I transfer, gift, or resell any ticket or pass associated with this Event to another individual, I understand and agree that the recipient shall be equally bound by the terms of this waiver. I am responsible for informing any transferee of these terms and ensuring their compliance.

Governing Law & Venue. This Agreement shall be governed by Colorado law. Any disputes or claims shall be exclusively submitted to courts in Pitkin County, Colorado.

Severability. If any provision is held invalid or unenforceable, the remainder shall remain in full effect.

AGSW 2027 Patron Pass: Payment Plan Terms

The Patron Pass Lock It In installment plan allows for the purchase of a Patron Pass (Total Value: $2,049) through three scheduled payments.

By opting into this plan, you agree to the following schedule and conditions:

Terms and Conditions
Final Payment Deadline: The full balance of $2,049 must be received no later than December 31, 2026.

Granting of Privileges: Patron Pass privileges (including event access, host benefits, and credentials) will not be granted if the full balance is not settled by the December 31 deadline.

Default on Payment: Failure to complete any installment may result in the forfeiture of previous payments and the cancellation of the pass reservation.Non-Transferable: Pass installments and associated benefits are non-transferable until the balance is paid in full.

I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST AGSW-AO AND ITS AFFILIATED PARTNERS AND SPONSORS, AND THE VENUE, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH
AGSW-AO.

BY PARTICIPATING, ATTENDING OR VOLUNTEERING YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT
PERMITTED BY LAW.
